BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 4 Mimosa Drive, being on the southwest line of Mimosa Drive at Dayton Boulevard. Lot 1, H.E. Lowenthal Resubdivision of part of Engle Estate, as shown by plat of record in plat book 17, page 14, R.O.H.C., being the property described in deed book 2704, page 725, R.O.H.C. Tax Map No. 99F-E-14. from R-2 Residential Zone to C-2 Convenience Commercial District. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. That the above-described tract of land be used only as a retail store, ornamental pond work and supplies. 2. Erection and maintenance of a sight-obscuring fence along the east side of the property. 3. No direct access allowed to Dayton Boulevard. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
